Lifestyle Pass Terms and Conditions
The Path Vacations Lifestyle Pass (“Lifestyle Pass”) is offered by Eastman Hill Enterprises, Inc., dba Path Vacations (“Path Vacations”). Purchase and use of the Lifestyle Pass are subject to the following terms and conditions, as well as all applicable resort rules, policies, and Path Vacations Club guidelines.
Term and Payment Obligations
The Lifestyle Pass is issued for a fixed term of three (3) years, totaling thirty-six (36) months, commencing on the date of enrollment. The cost of the Lifestyle Pass is Five Thousand Dollars ($5,000.00) per year. The first annual payment is due in full at the time of enrollment. Subsequent annual payments are due on each anniversary of the enrollment date for the remainder of the term, unless otherwise agreed to in writing by Path Vacations. Renewal following the expiration of the initial term is not automatic and, if offered, will be subject to then-current pricing and terms.
Reservation Deposit Option
Path Vacations may, at its sole discretion, offer prospective purchasers the option to place a refundable reservation deposit in the amount of Two Hundred Fifty Dollars ($250.00) to temporarily reserve availability for a Lifestyle Pass. Placement of a deposit does not constitute enrollment, activation, or access to Lifestyle Pass benefits.
The reservation deposit will be applied toward the first annual payment if the purchaser elects to proceed with enrollment. The deposit is fully refundable upon written request prior to execution of the final membership agreement, subject to any applicable administrative processing timelines.
Path Vacations does not guarantee continued availability of a Lifestyle Pass until a deposit or full payment has been received. If all available Lifestyle Passes are claimed prior to completion of enrollment, Path Vacations reserves the right to return the deposit in full and cancel the reservation without further obligation.
Failure to complete required payments may result in forfeiture of any reserved Lifestyle Pass and, where applicable, retention or refund of any deposit in accordance with the Reservation Deposit Option terms outlined herein.
Limited Availability
The Lifestyle Pass is offered in a limited quantity, as determined solely by Path Vacations. Availability is not guaranteed and may be modified, suspended, or discontinued at any time without prior notice. Once all Lifestyle Passes have been sold, no additional passes will be made available until the conclusion of the applicable term, and only if inventory becomes available.
Nature of Product
The Lifestyle Pass is a revocable license for day-use access to certain resort amenities and does not constitute a deeded interest, real estate interest, timeshare ownership, or equity in any property.
Eligible Members and Use Restrictions
A maximum of two (2) adult individuals may be listed as named members on a single Lifestyle Pass. All benefits associated with the Lifestyle Pass are personal to the named members and are non-transferable. The Lifestyle Pass may not be assigned, shared, or otherwise conveyed to any third party without the prior written consent of Path Vacations.
Resort and Amenity Access
The Lifestyle Pass provides day-use access to select resort amenities located at Steele Hill Resorts in Sanbornton, New Hampshire, and The Summit Resort in Laconia, New Hampshire, during the active term of the Lifestyle Pass. Resorts remain open to the public, and the Lifestyle Pass does not grant exclusive, guaranteed, or priority access to amenities. Overnight accommodations are not included with the Lifestyle Pass, and access to amenities at any other Path Vacations or affiliated properties is expressly excluded.
Reservations, Attendance, and Guest Limits
Certain amenities, including indoor pools, require advance reservations. Reservations may be made through the applicable member portal or by contacting the resort front desk. All members and guests must check in at the resort front desk and present valid government-issued photo identification prior to accessing any amenities. Day-use access is limited to a maximum party size of six (6) individuals, inclusive of at least one named member. A named member must be present and accompany the party for the full duration of amenity use. Amenity access may be time-limited and is subject to availability.
Availability and Operational Limitations
Amenity access under the Lifestyle Pass is subject to availability and may be limited, restricted, modified or unavailable due to maintenance, weather conditions, private events, capacity constraints, or other operational needs as determined by Path Vacations or the applicable resort. No credits, refunds, extensions, or substitutions will be provided for periods during which amenities are unavailable or access is restricted.
Rules, Conduct, and Compliance
All members and their guests are required to comply with all resort rules, policies, and Path Vacations Club guidelines, as amended from time to time. Failure to comply with such rules or policies may result in suspension or termination of Lifestyle Pass privileges, with or without notice, and without refund.
Assumption of Risk and Limitation of Liability
Use of resort amenities is undertaken at the member’s own risk. Members agree to assume all risks associated with amenity use and to hold harmless Path Vacations, its affiliates, officers, employees, and agents from any claims, injuries, losses, or damages arising from such use, except where prohibited by law.
Default and Suspension
Failure to make required payments when due, or violation of these Terms and Conditions or applicable resort or club rules, may result in suspension or termination of Lifestyle Pass access. Late fees, interest, and acceleration of remaining balances may apply as permitted by law and as set forth in the applicable membership agreement.
Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New Hampshire. Any disputes arising out of or relating to the Lifestyle Pass shall be resolved in the manner specified in the applicable membership agreement.
